TWU Nominees Pty Limited is the trustee of TWUSUPER (ABN 77 343 563 307) (‘the Fund’). The Trustee pays a fee for the provision of this service, however this fee is not conditional on you using this service or acting on the information or advice provided through this service.

General

TWUSUPER may from time-to-time amend, update or change the Site or the Content, including these Terms of Use, without prior notice.  Any subsequent access to and use of the Site by you will constitute an automatic acceptance of those amendments, updates and changes.

These Terms of Use and, where relevant, the terms of use for the secure site Member Online, constitute the entire agreement between you and TWUSUPER with respect to this Site.

If any provision of these Terms of Use is found to be invalid or unenforceable, that provision will be deemed deleted only to the extent that it is not enforceable.

Failure by TWUSUPER to insist upon strict performance of any of these Terms of Use will not be construed as a waiver of any right or remedy of TWUSUPER.

An e-mail which is sent to TWUSUPER is taken to be received by TWUSUPER when the e-mail message enters the electronic mail box of TWUSUPER and is able to be opened in readable form. Proof of receipt is established by an electronic or paper record of the date and time the e-mail message entered the electronic mail box of TWUSUPER and was able to be opened in readable form.

These Terms of Use shall be governed by the laws of Victoria, Australia, and each party submits to the exclusive jurisdiction of the courts thereof and the courts which have jurisdiction to hear appeals from those courts.
